Court Fee increases from 13 July 2026

The Ministry of Justice have confirmed a number of court fee rises which will take effect from 13 July 2026 (subject to parliamentary approval). There will be increases to 170 fees in line with inflation for 2024/25 and 27 fees which will increase by an average of 34%. Four fees will be reduced to reflect reductions in their underlying costs. Many Practitioners are likely to feel a sense of exacerbation at further court fee rises whilst other areas of costs such as Fixed Recoverable Costs continue to stagnate. The MOJ have restated the availability of the Help with Fees remission scheme which remains available for those with lower financial means.

The changes are not retrospective and are due to apply to fees paid on or after 13 July 2026.

There are changes to Civil Fees, Family Fees, Magistrate Fees, Upper Tribunal (Lands Chamber), First-Tier Tribunal (Gambling), First-Tier and Upper Tribunal (Immigration and Asylum Chamber), Non-Contentious Probate, Court of Protection, Enrolment of Deeds and Property Chamber.

Below are some stand-out fee changes:

  • Part 8 Costs Only proceedings from £67 to £69.

  • General Application without consent from £313 to £321

  • General Application by consent from £123 to £126

  • Default Costs Certificate from £80 to £82

  • Appeal (Detailed Assessment Proceedings) from £283 to £290

  • Request/application to set aside a Default Costs Certificate from £148 to £152

  • Request to set aside a default costs certificate from £79 to £81

  • Fixed Costs Determination from £398 to £408

  • Determination of costs, where costs claimed exceed £100,000 but does not exceed £150,000 from £1,365 to £1,400

  • Request for Detailed Assessment in Court of Protection from £99 to £102

  • Appeal against a Court of Protection costs assessment from £79 to £81
